Changes to the No Win No Fee Rules

In April the law regarding no win no fee cases was changed. The way the press covered the changes led some people to believe that making a personal injury claim would become prohibitively expensive.

Naturally, things have changed. However, it is still possible to make a personal injury claim without it costing anything to do so. If you approach it in the right way and use an experienced team of personal injury lawyers, you need not take on any kind of financial risk.

Mitigating the Risk

The first thing to do is to find a good personal injury lawyer. You need to look for a firm that is experienced in dealing with your kind of claim. Their experience will increase your chances of success.

Never use a firm that does not take the time to assess your case. The best firms will examine every case in detail, to work out the chances of winning that particular case. Any firm that takes all comers without question should be avoided.

Cover Every Base

Even if you are careful about only taking a strong case to court there is still a small chance that you will lose your case, and this is where things can get expensive. If you should lose your case, you will have to pay the legal costs of the successful party.

You should not be liable for your own lawyers’ fees. However, you could be if this is not stipulated in your contract with your lawyer. Read the small print and make sure that your contract specifically states that the lawyer will not charge you should you lose the case. Provided that is stipulated in your contract, the only fees you will have to pay should you lose are your opponents.

Fortunately, there is a way to cover these costs too. All you need to do is to take out a specialist insurance policy. These policies are called ‘after the event’ policies. Be careful to use a no win no fee lawyer that can guide you towards the right insurance policy for your particular case.
